Terms & Conditions
Sales
Title I, Online Sales
Version effective as of September 29, 2026.
Article 1. The seller
The website dyrsan.fr is operated by the company D'YRSAN, registered in France under SIREN number 897 537 015, intra-community VAT number FR85897537015, whose registered office is located at 78 avenue des Champs-Élysées, 75008 Paris (hereinafter "D'YRSAN").
Customer service: by email at shop@dyrsan.fr, or by phone and WhatsApp at +33 7 58 02 12 59. Shipping and return address: D'YRSAN, 3 rue Paul Déroulède, 92600 Asnières-sur-Seine, France.
Article 2. Scope of application
These general terms and conditions of sale (hereinafter the "GTC") govern the sales of products concluded on the online store dyrsan.fr between D'YRSAN and any person placing an order (hereinafter the "Customer"), whether acting as a consumer or as a professional.
These terms and conditions apply to fabrics sold by the meter, haberdashery accessories and supplies, samples, pre-ordered products, and D'YRSAN brand items sold in the online store. Workshop services (pattern making, prototyping, custom tailoring, production) and orders placed from a catalog reserved for professional clients are subject to separate terms and conditions, which are provided with the quote or the relevant catalog.
They are accessible via a link on the payment page, and the Customer accepts them by confirming their order. The applicable Terms and Conditions are those in effect on the date of the order; they remain available for consultation at any time on the website and can be saved or printed.
Article 3. Products
The essential characteristics of each product (material, composition, width, weight, color, sales unit, minimum quantity) are presented on its product page. The customer is advised to read them before ordering.
The photographs are taken with the utmost care. However, colors may vary slightly depending on the screen used and from one dye lot to another for the same fabric. These variations in appearance do not constitute a defect. To choose a color or material, the Customer can order a sample when the product description offers this option.
Many fabrics come from end-of-line stock and surplus stock from fashion houses and suppliers, available in limited quantities and rarely replenished. Products are offered subject to availability.
Fabrics sold by the meter are cut to the ordered length. Multiple units of the same fabric ordered in the same line are delivered in one continuous piece whenever possible. If the remaining yardage does not allow for this, D'YRSAN will inform the Customer before shipment, and the Customer will then choose between delivery in several pieces and cancellation of the line, with a full refund.
A minimum order quantity may apply to certain products; it is indicated on the product page and applied when adding to the cart.
Article 4. Prices
Prices are shown in euros, inclusive of all taxes (French VAT applicable on the day of the order), excluding delivery charges. Delivery charges, which include preparation and packaging fees, are shown before order confirmation, depending on the delivery method and destination chosen. Free delivery may be offered for orders exceeding a certain amount indicated on the website.
The price charged is the one displayed at the time the order is validated. In the event of a clear display error (for example, a price unrelated to the product's value), D'YRSAN may cancel the order in question and issue a full refund, after informing the Customer.
Discount codes cannot be combined unless otherwise stated, apply under the conditions indicated when they are issued and cannot be exchanged for money.
For deliveries outside the European Union, customs duties, local taxes, and clearance fees may be levied by the authorities or the carrier in the destination country. These remain the responsibility of the customer.
Article 5. The order
The Customer selects their products and quantities, verifies the contents of their basket, enters their contact information and delivery address, chooses their delivery method, and then their payment method. They can correct each of these details before confirming. Order confirmation, which implies an obligation to pay, and accepted payment constitute the contract.
D'YRSAN sends the Customer a confirmation email summarizing their order. The Customer should ensure the accuracy of their email address and check their spam/junk mail folder if necessary. The invoice is available in the customer area or upon request.
If a product becomes unavailable after an order is placed (particularly for a single-quantity item sold simultaneously), D'YRSAN will inform the Customer as soon as possible. The Customer can then choose between a replacement product of equivalent quality and price, if one is available, and a refund for the unavailable product, which will be issued within fourteen days.
D'YRSAN may refuse or cancel an order in the event of a prior unresolved payment dispute with the Customer, serious suspicion of fraud, or abnormal quantities for non-professional use. The Customer will be informed and any amount received will be refunded.
Article 6. Pre-orders
Some fabrics are available for pre-order for a limited time, indicated on their product page along with an estimated shipping date. Payment is due upon ordering. Once the pre-order period closes, D'YRSAN orders the fabric from its supplier.
If the material cannot ultimately be obtained, in whole or in part, or if the announced shipping date cannot be met, D'YRSAN will inform the Customer without delay. The Customer may then cancel the order in question and obtain a full refund of the sums paid, within fourteen days.
Article 7. Payment
Payment is made online at the time of ordering, by credit card, Apple Pay, Google Pay, or Bancontact, depending on the payment methods offered. Payments are processed by a secure payment provider; D'YRSAN never has access to the card's full details.
The order is only prepared after payment has been accepted. An order whose payment fails (bank refusal, incomplete 3D Secure validation) remains pending; a link to complete the payment may be sent to the customer, and the order is then cancelled if payment is not received.
The products remain the property of D'YRSAN until full and effective payment of the price.
Article 8. Delivery
Products are delivered to the address or collection point indicated by the Customer, in the countries offered during the ordering process, by the carriers and according to the methods presented at the time of ordering (including La Poste, Colissimo, Chronopost, Mondial Relay, and Delivengo). Preparation and delivery times are indicated at the time of ordering.
In the absence of a specified date or deadline, delivery will take place no later than thirty days after the conclusion of the contract. If this deadline is exceeded, the consumer may request D'YRSAN, in writing, to deliver within a further reasonable period; if delivery is not made within this period, the consumer may terminate the contract in writing, and any sums paid will be refunded within fourteen days, in accordance with Articles L. 216-6 and L. 216-7 of the French Consumer Code.
For the consumer customer, the risk of loss or damage to the products is transferred to them when they, or a third party designated by them, take physical possession of the products. Until that moment, a package lost or damaged during transport is the responsibility of D'YRSAN, which will, at the customer's option, either send a replacement or issue a refund, after an investigation with the carrier when necessary.
The Customer must check the condition of the package upon receipt. If it is open, damaged, or unusually light, they should make specific reservations with the carrier or collection point, or refuse the package, and notify D'YRSAN as soon as possible, providing photographs. These steps facilitate processing without depriving the Customer of their rights.
When the package is returned to D'YRSAN due to the Customer (incomplete or incorrect address, absent recipient, package not collected from relay point within the carrier's time limit), D'YRSAN contacts the Customer: the package is reshipped after payment of new delivery charges, or the order is refunded, less the initial delivery charges and, where applicable, the return charges billed by the carrier.
Title II, Returns, Exchanges and Claims
Article 9. The right of withdrawal
The consumer has a period of fourteen days to withdraw from the contract without having to give any reason. This period begins on the day the customer takes physical possession of the products; when an order is delivered in several packages, it begins upon receipt of the last package.
Excluded products. In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal does not apply:
- to fabrics and articles sold by the meter or length, cut to the size chosen by the Customer, which are goods made according to his specifications; ;
- to personalized products or products made at the request of the Customer; ;
- to products which, after delivery, have been washed, cut, sewn, dyed or transformed, or which have, by their nature, been inseparably mixed with other articles.
These exclusions do not deprive the Customer of legal guarantees or of the treatment provided for in Article 11 in the event of an error by D'YRSAN or a product defect.
How to retract. The Client informs D'YRSAN of its decision before the expiry of the deadline, by an unambiguous statement addressed to shop@dyrsan.fr or by mail, indicating the order number and the products concerned. The customer may use the form at the end of these Terms and Conditions, but this is not mandatory. D'YRSAN acknowledges receipt of the cancellation.
The return. The Customer must return the products no later than fourteen days after notifying D'YRSAN of their decision, to the return address indicated in Article 1. Return shipping costs are the Customer's responsibility. It is recommended to use a tracked shipping method: until received by D'YRSAN, the products travel under the Customer's responsibility. Products must be returned complete, in protective packaging, and accompanied by the order number.
The refund. D'YRSAN will refund all sums paid for returned products, including the initial delivery charges at the rate of the least expensive standard delivery offered, no later than fourteen days after being informed of the cancellation. D'YRSAN may withhold reimbursement until the products have been received, or until the customer has provided proof of shipment, whichever occurs first. The refund will be issued using the original payment method, at no cost to the customer. If only part of the order is cancelled, the initial delivery charges will only be refunded if the entire order is returned.
The Customer may be held liable for any depreciation of the products resulting from handling other than what is necessary to establish their nature, characteristics, and proper functioning. An incomplete, damaged, soiled, or altered return may therefore result in a partial refund, proportional to this depreciation, after the Customer has been informed.
Article 10. Exchanges
A product eligible for return can be exchanged for another product within the same fourteen-day period. The exchange is made by returning the product in accordance with the conditions of Article 9, followed by a new order. At the customer's request, the value of the returned product can be converted into a credit note valid for twelve months on the online store. The customer is responsible for the return shipping costs and the cost of reshipping.
Cut fabrics and products excluded from the right of withdrawal are neither returnable nor exchangeable, except in the case of an error by D'YRSAN or a product defect (Article 11). D'YRSAN may, however, as a purely commercial gesture and without this constituting a right, offer a solution on a case-by-case basis.
Article 11. Preparation error, defective or damaged product
If the Customer receives a product different from the one ordered, a quantity less than ordered, a product damaged during transport, or a defective product, they must inform D'YRSAN at shop@dyrsan.fr Please include your order number and photographs of the product, label, and packaging. It is recommended to do this upon receipt, and in any case before washing, cutting, or altering the fabric: a defect noticed before any intervention is easier to document.
After verification, D'YRSAN offers the Customer a credit note for the amount of the product in question, excluding delivery charges, valid for use on the entire online store for twelve months. Customers who prefer may request, instead of a credit note, the shipment of the missing product or the additional yardage, a replacement of the product if it is still available, or a refund to the original payment method. In most cases, photographs are sufficient: no return is required, and the Customer keeps the product. However, D'YRSAN may request the return of a product for examination; the return shipping costs are then borne by D'YRSAN, as stipulated by law. No product returned without prior agreement from D'YRSAN will be refunded for its shipping costs. This procedure is without prejudice to the legal guarantees outlined in Article 12.
The following are not considered defects: slight color variations described in article 3, characteristics specific to a material described on the data sheet (irregularities of an artisanal weave, slubs, relief, transparency), nor the effects of maintenance not respecting the instructions provided.
Article 12. Legal guarantees
All products are covered by the legal guarantee of conformity (Articles L. 217-1 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), which the consumer may invoke under the conditions outlined below. D'YRSAN does not offer any additional commercial warranty.
The consumer has two years from the date of delivery of the goods to invoke the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to prove the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity gives the consumer the right to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.
The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund upon return of the goods, if: 1° the professional refuses to repair or replace the goods; 2° the repair or replacement of the goods takes place after a period of thirty days; 3° the repair or replacement of the goods causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-conforming goods, or if he bears the costs of installing the repaired or replacement goods; 4° the non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or cancellation of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or cancellation. In such cases, the consumer is not required to request repair or replacement of the goods beforehand. The consumer is not entitled to cancellation of the sale if the lack of conformity is minor.
Any period during which the goods are unavailable for repair or replacement suspends the remaining warranty period until the repaired goods are delivered. The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased up to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects, pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund upon return of the goods.
Article 13. Use of products and liability
Fabrics and supplies are raw materials intended to be worked. It is the Client's responsibility to verify that a product is suitable for its intended use, to follow the care instructions provided, and, for materials that may shrink, to test or pre-wash the fabric before cutting. D'YRSAN cannot be held liable for the result of any garment made by the Client or a third party, nor for any damage resulting from use that is not in accordance with the intended purpose of the product.
Nothing in these Terms and Conditions limits D'YRSAN's liability to the consumer Client beyond what is permitted by law, nor does it deprive them of legal guarantees.
Title III, Final Provisions
Article 14. Business Clients
Customers purchasing for business purposes are not entitled to the right of withdrawal (Article 9), and consumer protection provisions do not apply. Risk of loss or damage passes to the customer upon delivery of the goods to the carrier. Return shipping costs are the customer's responsibility, regardless of the reason for return. Any claim relating to an apparent defect, error, or missing item must be submitted in writing within eight days of receipt, along with photographs; otherwise, the goods will be considered accepted.
In the event of late payment of an invoice, late payment penalties are automatically due at the interest rate applied by the European Central Bank to its most recent refinancing operation, plus ten points, as well as a fixed compensation for recovery costs of 40 euros (Article L. 441-10 of the Commercial Code).
D'YRSAN's liability to a professional Client is limited to the price of the products concerned and excludes indirect damages, such as loss of business or loss of profits.
Article 15. Force majeure
Neither party shall be liable for any failure to perform due to a force majeure event as defined in Article 1218 of the French Civil Code (including, but not limited to, transport strikes, natural disasters, and administrative decisions). The affected party shall inform the other party without delay. If the impediment lasts for more than thirty days, either party may cancel the order in question, and any sums paid for undelivered goods shall be refunded.
Article 16. Intellectual Property
The texts, photographs, visuals, logos, and content of this website are the property of D'YRSAN or its partners. Any reproduction or use without prior written authorization is prohibited. Purchasing a product does not grant any rights to the D'YRSAN trademark or to its proprietary designs and creations.
Article 17. Personal Data
The data collected during the ordering process is necessary for its processing, delivery, invoicing, and customer relations. Its processing, retention period, and the Customer's rights (access, rectification, erasure, objection, restriction, portability) are described in the Privacy Policy. The Client may exercise their rights to shop@dyrsan.fr and contact the CNIL.
Article 18. Complaints and Mediation
All complaints should be addressed to customer service at shop@dyrsan.fr or by mail to the address indicated in Article 1. D'YRSAN will endeavor to respond as soon as possible.
In accordance with Articles L. 612-1 et seq. of the French Consumer Code, the consumer may have recourse, free of charge, to a consumer mediator for the amicable resolution of a dispute, after having sent a written complaint to D'YRSAN that has remained unsatisfactory. The contact details of the competent mediator are available upon request. shop@dyrsan.fr.
Article 19. Applicable Law and Disputes
These Terms and Conditions are governed by French law. Consumer Clients residing in another European Union country retain the benefit of the mandatory provisions of the law of their country of residence. In the absence of an amicable settlement, the dispute shall be brought before the competent court in accordance with the rules of ordinary law; the consumer Client may, in particular, bring the matter before the court of the place where they resided at the time the contract was concluded. For business Clients, exclusive jurisdiction is granted to the courts within the jurisdiction of the Court of Appeal of Paris.
If any provision of these Terms and Conditions is declared invalid, the remaining provisions shall remain in full force and effect. D'YRSAN may modify these Terms and Conditions at any time; the Terms and Conditions applicable to an order are those in effect on the date of its validation.
Appendix. Withdrawal form
Please complete and return this form only if you wish to withdraw from the contract, and only for a product that is not excluded from the right of withdrawal.
